Red Box User Agreement
By using the website (The Site) of Red Box Rewards India Pvt. Ltd (herein referred to as Red Box) ie redboxrewards.com website, you (The User) are deemed to have accepted the terms and conditions listed below. Red Box reserves the right to add, delete, alter or modify these terms and conditions at any time. We recommend that you read these terms and conditions carefully when transacting on the website.
- The User certifies that he/she is at least 18 years of age or has the consent of a parent or legal guardian.
- The User is responsible for providing true, accurate and complete information about himself/herself in the Red Box registration form and for maintaining the confidentiality of his/her account. The User agrees to accept responsibility for all activities that occur under his/her account or Password. If Red Box finds the information incorrect in any way, it reserves the right to cancel the registration
- All prices are in Indian rupees and Red Box Reserves the right to change the prices and availability status of products on The Site without any prior intimation.
- In no event shall Red Box or any of the suppliers??? listed on Red Box be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Red Box website, its services or this agreement (however arising, including negligence). Red Box and its associates and suppliers make no warranties about the accuracy and, currentness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Site or that the operation of the Site will be error free and/or uninterrupted.
- The User agrees to indemnify and hold Red Box and our associates, employees and suppliers harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of the User Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
- Red Box reserves the right to cancel or refuse any order placed for a product that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card. In the event the payment has been processed by redboxrewards.com the same shall be credited to your credit card account and duly notified to you by email.
- Red Box will not entertain any request for cancellations of orders once duly placed on The Site
- Red Box will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user
- In the event of any non-delivery arising on account of a mistake by the User, any extra cost incurred by Red Box for redelivery shall be claimed from the User placing the order.
- Red Box shall not be liable for any delay / non-delivery/damage of goods of purchased goods by the suppliers, flood, fire, wars, acts of God or any cause that is beyond the control of Red Box
- The User agrees to use the services provided by Red Box , its affiliates, consultants and contracted companies, for lawful purposes only
- Red Box shall not be responsible for any damage suffered by users from use of the services on The Site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.
- The User expressly agrees that the use of service(s) on The Site is at the User's sole risk. The Service(s) of the Site is provided on an "as is" basis without warranties of any kind, whether express or implied. Red Box its affiliates, employees, agents, consultants, contracted companies make no warranties of any kind, whether expressed or implied, for the service it is providing or as to the results that may be obtained from use of the Service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this Service. Red Box does not represent or warrant to maintain the confidentiality of information; although Red Box’s current practice is to utilize reasonable efforts to maintain such confidentiality. It is also clearly understood that all warranties, implied or express take place between the vendors and the User.
- The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement/All claims are subject to the jurisdiction of local court only at Mumbai, India.
